Upon deposit payment and delivery/collection of Just Joy Events Ltd rented items, the customer agrees to all terms and conditions.

This website is operated by Just Joy Events Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Just Joy Events Ltd. JJust Joy Events Ltd offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms & Conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms & Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. The Client agrees to the following terms and conditions on payment of deposit and/or collection of goods and services.

 

Please read these Terms & Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms & Conditions. If you do not agree to all the terms & conditions of this agreement, then you may not access the website or use any Services. If these Terms & Conditions are considered an offer, acceptance is expressly limited to these Terms & Conditions. 

 

Any new features or tools which are added to the current store shall also be subject to the Terms & Conditions. You can review the most current version of the Terms & Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms & Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. 

 

Our store is hosted on Wix.com. They provide us with the online e-commerce platform that allows us to sell our products and Services to you. 

 

 

SECTION 1 - ONLINE STORE TERMS 

 

By agreeing to these Terms & Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. 

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 

You must not transmit any worms or viruses or any code of a destructive nature. 

A breach or violation of any of the Terms will result in an immediate termination of your Services. 

 

1. Dispatch Time: Orders are usually dispatched within 2 business days of payment of order, Our warehouse operates on Tuesday - Friday during 09.00am-3pm, except on national holidays at which time the warehouse will be closed. In these instances, we take steps to ensure shipment delays will be kept to a minimum.

 

2. Items Out Of Stock

If an item is out of stock, we will wait for the item to be available before dispatching your order. Existing items in the order will be reserved while we await this item.

 

3. Delivery Time Exceeded

If delivery time has exceeded the forecasted time, please contact us so that we can conduct an investigation.

 

4. Parcels Damaged In Transit

If you find a parcel is damaged in-transit, if possible, please reject the parcel from the courier and get in touch with our customer service. If the parcel has been delivered without you being present, please contact customer service with next steps.

 

5. Process for parcel damaged in-transit

We will process a refund or replacement as soon as the courier has completed their investigation into the claim.

 

6. Process for parcel lost in-transit

We will process a refund or replacement as soon as the courier has conducted an investigation and deemed the parcel lost.

 

7.Shipping costs are calculated during checkout based on  the destination of the items in the order. Payment for shipping will be collected with the purchase.

This price will be the final price for shipping cost to the customer.

 

8.For any and all services (e.g. florals, delivery and collections, signage and stationery, set-up and pack-down) ,the job has been accepted based on the discussed requirements. If for any reason those requirements reduce, there is no change in the service pricing, and the booking fee paid to secure these services is non-refundable.  Where the Client requests additional support to that initially quoted for, there will be an increase in service fee, and this will be quoted and presented to the Client to accept prior to work being carried out.

 

9. Where the Client has not viewed or inspected items prior to a booking commencing they understand that while the Company describes items as well as possible on their website, the Company is not responsible where the Client finds items unsuitable

 

10.Delivery time:In general, domestic shipments are in transit for 2 - 7 days. The Client understands that items which are sent via courier or freight carry the risk of damage and delays.

 

 

SECTION 2 - GENERAL CONDITIONS 

 

We reserve the right to refuse Service to anyone for any reason at any time. 

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us. 

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms. 

 

SECTION 3 - TERMS & CONDITIONS OF HIRE SERVICES

 

CUSTOMER RESPONSIBILITY & SAFETY

 

1.Our some hire products like plinths have a non-fixed acrylic table top, it is the customers responsibility to insure the table, base are kept balanced and in a safe/stable position at all times with not too much weight placed on top. Just Joy Events Ltd will not be held responsible for any damages to goods placed on the table.

 

2. Our many wooden backdrops and props are for indoor use only, are not waterproof and cannot be displayed outdoors, in the rain/wind or when the ground is damp. If backdrops are moved after set up, any damages incurred will be invoiced. Please check with our customer service staff before placing your order to see if it can be used outdoors or to check the details in the product pages.

 

3.The Client is responsible for checking all items prior to taking possession. Any claims of damages, faults or shortages must be made immediately on collection or delivery to the Company. Where the Company is only notified on or after the return of items, or where the Client was unable to inspect the items prior to possession, the Client is not entitled to dispute these and is responsible for all costs involved with any damages, faults or shortages incurred by the Company.

 

4.The hirer has agreed to the nominated pick up date & drop off date.

 

5. All items hired cannot be substituted without formal consent.

 

6. Your quotation is valid for 7 working days only and if deposit is not paid the items will not be locked in for the hirer’s event. Just Joy Events Ltd is entitled to refund the deposit if the deposit payment has been made after the 7 working days’ period.

 

7. The hirer is responsible for all items to be returned without any damages.

 

8. All hired items to be returned at in clean condition - please ask if you unsure of the cleaning process of the hire items.

 

9. Hired items will be inspected upon return. Please note that any damage or breakage to the items it will be taken out from the bond. In the event the damaged items are beyond repair Just Joy Events Ltd is entitled to bill the client the equivalent market value.

 

10. Hirer must bring a vehicle that can facilitate the hired items. Just Joy Events Ltd reserves the right to refuse hire if the Hirer cannot achieve the minimum care requirement for transportation.

 

11. The hirer is responsible for securing the backdrop and adding adequate weight behind the backdrop to avoid falling.

 

12. The hirer must use proper tools and equipment to securely fix the back support to the backdrop.Just Joy Events Ltd will not be responsible for inadequate fixing and human errors in installation which has caused damages and bodily harm.

 

13. To ensure the item[s] is/are fully respected, the customer is responsible for the behaviour and safety of their event guests at all times.

 

14. The customer is responsible for ensuring Just Joy Events Ltd Hire item[s] is/are prevented from abuse or damage.

 

15. Any damage to the venue property incurred during the hire period of a Just Joy Events Ltd Hire item or items is to the cost of the customer.

 

16. The customer is responsible for ensuring onsite representatives are made fully aware of all obligations from this terms & conditions and additional item rules provided by Just Joy Events Ltd. The customer is responsible for ensuring all guests are aware of any necessary safety issues and/or hazards surrounding the hired items from Just Joy Events Ltd.

 

 

JUST JOY EVENTS RESPONSIBILITIES

 

1. Subject to the terms of this agreement, we will provide to you the selected item[s], between the stated start and finish dates and times. 

2. For any hired backdrops which requires back support, Just Joy Events will be providing all supporting parts to the hirer and including the correct size screws for installation.

 

 

 

ITEM RENTAL PERIOD

 

1.This Agreement applies to all Products on hire by Just Joy Events Ltd to the Hirer. The hire period commences at the time the Product leaves the possession of the Company.  The hiring shall terminate at the time the Product is delivered back to or otherwise arranged with the Company.  

 

2.The rental period for an item is 3 days.

 

3.If the product is not returned for more than 6 days without receiving contact with the owner about the extension, it is considered theft, and all details will be handed to Police. Additionally, all costs as outlined within this agreement also apply.

 

4. Customers may request to rent an item for 1 day only, but the price remains the same as a 3-day hire period. 

 

5. If the customer wishes to extend the number of rental days past 3 days, the extension of the period must be agreed to the Owner, and the customer will be charged 35% of the item fee [exclusive of GST], per additional day. The same charge applies if the item[s] is/are returned late.

 

6.Pick up on workday between 10am and 2pm; then return on the next following Monday between 10am and 2pm. If a public holiday should fall on a Monday, the Hirer must return their hired items on Tuesday. If a public holiday should fall on a Friday, the Hirer is to pick up their hired items on Thursday. If the hirer rent the items during weekdays. All products are hired out on a 2-day hire basis. For example, Monday to Wednesday or Tuesday to Thursday. If you wish to extend the rental days to One week, you will only be charged for twice the price of the weekend’s rental (from Friday to Monday) fee.

 

 

HIRED ITEMS

 

1.All hire items are for hire only - including custom signage boards and florals.

When a balloon garland is part of the hire package, the customer has the opportunity to keep this at the end of the event, if no-one has expressed interest in keeping the balloon garland, Just Joy Events Ltd will remove/destroy it upon collection.

 

2.Just Joy Events will try their best to replicate a balloon garland based on photos, however cannot guarantee that colours or the overall look will be exactly the same. The sizes of the balloons used and their positioning along with the length of the garlands can vary. Any added floral/flowers used in the garlands remain property of Just Joy Events and these are placed into the garlands at our discretion.

 

3. Hired items remain the property of Just Joy Events Ltd.

 

4. We make every attempt to supply items as requested but if due to circumstances outside our control we are unable to supply exactly as requested we reserve the right to substitute with a similar products.

 

 

COLLECTION AND RETURN

 

1. Please ensure your vehicles have suitable space for items being transported: Covered vehicles only, such as vans and trucks (OPEN TRAILERS may be considered if the weather condition is good), the Owner may refuse to lend the Hirer items if the vehicles are deemed unsafe or unsuitable.

 

2.Items must be secured by heavy duty straps to prevent falling off or moving around vehicles.

 

3.A $50 late fee will be charged if the Hirer or the Hirer’s authorised pick-up person arrives more than 30 mins but no more than 60 mins past the scheduled pick-up time without notice. If the Hirer or the Hirer's authorized pick-up person arrives more than 60 minutes past the scheduled pick-up time without notice, the Owner reserves the right to cancel the booking without refund. This provision is necessary to ensure the timely and efficient management of the Owner's rental equipment.

 

4.A $50 late fee will be charged if the Hirer or the Hirer’s authorised drop-off person arrives more than 30 mins but no more than 60 mins past the scheduled return time without notice. If the Hirer or the Hirer's authorized pick-up person arrives more than 60 minutes past the scheduled pick-up time without notice, a full bond may be deducted,

If our hired items are not available to be collected on or before the agreed collection time, an additional hire fee may be charged. This additional fee will be due within 7 days of the hire period.

 

5.In the event of a late return, the Hirer MUST notify the Owner and arrange a new return time. (Please note: Additional charges apply). Failure to return the item(s) and being uncontactable for a period exceeding 24 hours will be considered a breach of this T&Cs. The matter will be treated with utmost seriousness and may be deemed as theft. In such cases, relevant agencies, including debt recovery agents, may be notified, and your details will be passed to them for further action.

 

6. The Client is responsible for repackaging of the hire items being transported back to Just Joy Events Ltd.

 

7. All packaging used for hire items must be returned with hire items in correct original packaging. Where items are not returned in this condition, charges are applicable. The Client accepts that they can not dispute this on the return of the items, for example offer to collect and clean, amend or fix the items themselves.

 

8. If damage occurs due to repackaging by Client, the Client will be liable for the subsequent costs.

 

9. Collection and return of all items are to our premises.

 

10. All hire bookings are due back no later than 2pm on the due date.  Anytime after this is considered late and is charged at 35% per day.

 

11. Customers are required to collect their item[s] on a workday between 9am and 4pm and return their item[s] on the following Monday between 10am and 2pm, unless alternative arrangements are made between the customer and Just Joy Events Ltd. Alternative collection days are possible if the item is priced at $50.00 or above.

 

12.Customers must check that they are happy with their item[s] and notify Just Joy Events Ltd at the time of collection if they observe any prior damage to their item[s].

 

 

DELIVERY

 

1. Delivery charges are calculated from . the costs are calculated during checkout based on  the destination of the items in the order. Payment for shipping will be collected with the purchase. This price will be the final price for shipping cost to the customer.

 

2.The delivery (Delivery and Pick-up) charge exclude GST, starting from $120.00NZD for the Upper & Lower North Shore; Hibiscus Coast, Auckland City and Central Auckland, Waitakere & Huapai for $150.00NZD; Manukau North & Howick for $180.00NZD; Manukau South for $200.00NZD. For more information, please email us to discuss. Please find your area on the area map at the checkout with selecting ‘Delivery’.

 

3. A distance of 25km or under. If further than 25km, customers will be charged an additional $3.00 per km. The delivery charge is provided on the individual customer invoice.

 

4. Please note that the prices quoted on the DELIVERY on Just Joy Events website do not include a delivery fee, unless stated otherwise.

 

5. Please note that some items are for delivery only. Please see the website [justjoyevents.co.nz] for details on the items that are for delivery only

 

6. Help with item set-up is NOT included in the delivery charge. Delivery take place from door-to-door.

 

7. Customers must check that they are happy with their item[s] and notify Just Joy Events at the time of delivery if they observe any prior damage to their item[s].

 

8. Delivery is strictly a “DROP & GO” service at an easily accessible, ground level or in garage premises. Hired items must be located at an easy access point on street/ground level by an entrance/loading dock for easy delivery/pick up. Beyond these locations will incur an extra charge.

 

9. Please ensure that the entrance into the venue and set up location does not have sharp corners along the way or close walls/objects adjacent to the doors which will be used (this also applies to access through lifts), as some of our bigger items are 2.4m long and unable to bend. Please advise if there are many stairs (15+ steps) or vehicle parking to get into the venue is more than 40 meters, as some of our walls are very heavy and additional staff may need to be placed on the job. Our backdrops and hire props will only be set up in a place that is suitable. We have the right to cancel if access to the desired location is too difficult; unsuitable, unsafe or there is a risk to our property being damaged - in this instance refunds would not be offered.  A flat and even surface with little to no wind is need for setting up our backdrops outdoors.

 

10. Set up, delivery and collection times are an indication only however Just Joy Events Ltd will try their best to meet these times. It's advised to allow at least 2 hours prior to the event starting time. If the customer needs the set up to occur at a time closer to the event starting time the customer must communicate that to Just Joy Events Ltd to ensure it can be met. Just Joy Events Ltd can only agree to changes to these times if it is able to be met within our schedule, please note up to 20 bookings can be in our schedule for one day. If a change to times can not be met resulting in a cancelled booking we will refund based on our refund policy.

 

11. The Client understands that items which are sent via courier or freight carry the risk of damage and delays,

 

12. The Company is not liable for any delays caused by circumstances beyond their control, or breakages in transit.

 

Extra charges may apply if: 

  • You wish for your items to be taken beyond ground level of a building

  • Your event space is more than 25m from where our truck can park or pull up

  • If your items need to pass via stairs, elevators, escalators or a steep descent.

  • If you require a large quantity of items, a labour fee may be added to cover for staff time taken to load and unload the truck.

  • If you require a drop off or pick up outside the hours of 9am-5pm on Fridays and Mondays (e.g. weekends, midnight pick-ups and public holidays etc.)

  • Locations/Venues with difficult delivery/pick up entrance/loading dock access may incur additional charges.

  • Bump in is when the Hirer is ready to receive the items without delay. Access to the venue must be available at the agreed delivery and collection time. If access is not available an additional fee may be charged.

  • Bump out is when items are cleaned and packed up by the Hirer and items are ready to be picked up without delay. Any delays will incur an additional charge.

 

 

SET UP / PACKDOWN

 

1.If Just Joy Events Ltd have not been advised the location for the set up at the venue and cannot contact the customer, Just Joy Events Ltd Ltd will set up in a location they feel fits best.

 

2.Should you require a backdrop to be moved during your event, this will cost an additional charge to cover additional time and travel.

 

3.Access to the venue must be available at the agreed delivery time. If access is not available an additional fee may be charged.

 

 

CLEANING & PRODUCT HIRE CONDITIONS

 

1. If hire items are not collected in original condition, This includes removing all balloons, flowers, or any form of decoration that was not supplied with the Hire Equipment, and properly cleaning any soiled or dirty items, additional fees may be charged.

 

2.All items must be cleaned properly before returning to Just Joy Events. If the Hire Equipment is not returned in a clean and condition, the Owner reserves the right to charge a cleaning fee depending on the extent of the cleaning required. The amount of the cleaning fee will be determined by the Owner and deducted from the security/damage bond held by the Owner.

 

3. If vinyl or signage is placed on any products, it is the responsibility of the Hirer to remove them after use. Failure to do so may result in a cleaning fee to remove the vinyl or signage, which will be charged to the Hirer.

 

4. Wax must be removed from all candle holders before returning.

 

 

LOSS OR DAMAGE

 

1. Any loss or damage to the backdrop/hire props will be invoiced and due within 7 days of the hire period.

 

2. The Hirer acknowledges full responsibility for the equipment and shall be liable for any damage or loss caused to the equipment. The Hirer is responsible for the cost of repairing or replacing the Equipment in the event of any damage or loss, except for reasonable wear and tear.

 

3. The Client is responsible for the correct use of all hired items and must guard against misuse, damage or loss of items from the time of pick up (or delivery) from Just Joy Events Ltd until return from Client (or Collection by Just Joy Events Ltd).

 

4. The Client will ensure the correct way installing all props and shall not attempt to alter, repair or modify items.

 

5. Chair sashes must all be untied before returning.

 

6. The Client must ensure correct use of candles and in accordance to venue requirements. Wax damage to table linen will incur extra charges.

 

7. The Client agrees not to use the equipment at locations or purposes different to the equipment’s general designated purpose and specified suitability, such as indoor vs. outdoor use. The Client acknowledges responsibility for equipment and is liable for any damage.

 

8. If hire items are returned damaged, broken, heavily stained or missing items will be charged at full replacement costs and/or repairs will be charged for damage to or loss of any hire item or packaging.

 

9. The Hirer shall not have any claim against the Company for loss or damage suffered by the Hirer as a result of the Hirer’s use of the Product and furthermore the Hirer will indemnify the Company against any claim by any third person in respect of any loss, injury or liability arising from this hiring or arising out of the use of the Product hired by the Hirer.

 

10. Breakdown resulting from misuse shall not in any circumstances shorten the period of hire.

 

11. It is the Hirers responsibility to satisfy itself that the product is suitable for the intended use.

 

12. The Company is not liable for any loss suffered by the Hirer or liability incurred by the Hirer as a result of the breakdown of the Product howsoever caused. Notwithstanding the foregoing any liability attaching to the Company under this agreement shall be limited to the amount of hireage charges due under this Agreement. In the event of breakdown the Hirer must immediately notify the Company and take all necessary steps to prevent further damage.

 

13. The Hirer must take all reasonable precautions to protect the Equipment from damage or theft during the hire period, including storing it in a secure and dry location.

 

14. All packaging materials and tools provided with the Equipment must be returned with the hired goods, in good condition and in the same quantity as received. Any missing or damaged items will be charged to the Hirer.

 

15.It is the Client’s responsibility for any damage during the period which it is on hire. This includes insurance of the goods while in Client’s possession due to theft, fire, flooding, earthquakes, vandalism, confiscation or any other events resulting in loss or damage.  Loss is where the item has not been returned, or broken. Damage is when an item is not suitable for re-hire or requires repair.

In the event of any damage or loss, the Client will be charged the replacement cost (including shipping if applicable). Where a security bond has been charged, replacement costs will be deducted from the security bond paid, and if replacement costs exceed the bond, these will need to be paid directly to the Company by the Client.

 

16. All items remain the property of the Company, including damaged items.

 

LED and NEON Lights Safety Instructions

 

Upon deposit payment and delivery/collection of Just Joy Events LED and Neon Lights, the customer agrees to follow the following LED and Neon Lights Safety Instructions. 

 

1. Please be aware that the LED lights supplied are made of metal. Gloves and safety glasses must be worn at all times when touching the apparatus. This includes any installing or removing of lights and/or other maintenance. Lights must be removed extremely gently to avoid any scratches or damage. 

 

2. LED lights can be connected directly to a power source of 220v. 

 

3. Precaution must be taken with the LED lights on windy days. Just Joy Events reserves the right to cancel the rental of LED letters should they believe that the item[s] could be damaged from weather conditions and/or dangerous to the customer and his or her guests. 

 

4. LED and Neon lights must not be used outdoors if it is raining. Just Joy Events reserves the right to cancel the rental of lights should they believe that the item[s] could be damaged from weather conditions and/or dangerous to the customer and his or her guests. 

5. Neon lights must not be connected to a power source of 220v unless attached to a transformer that Just Joy Events provides first. 

 

6. Children and/or animals must be supervised at all times around the lights, to avoid any unnecessary injury or damage to the lights. 

 

7. Guests should not stand close to or lean on the lights, to avoid any unnecessary injury. 

 

8. Photos should not be taken in close proximity to the LED and Neon lights to avoid any unnecessary injury. 

 

9. The customer agrees to indemnify and hold Just Joy Events Ltd harmless for any claims from the customer’s use or misuse of the LED and Neon Lights, including any third parties for loss, injury and damage to persons or items/property arising out of the customer’s negligence or operation including legal costs incurred in defence of such claims. 

 

 

NO ASSIGNMENT OF HIRE AGREEMENT

This Agreement is personal to the Hirer and is not capable of assignment by the Hirer, and the Hirer shall not sublet the product to any other person.

 

COMPANY’S RIGHT TO CANCEL

 

1. Just Joy Events Ltd reserves the right to cancel item collection/delivery should they consider that the customer is unsuitable to take care of the item[s] properly. 

 

2.Just Joy Events Ltd reserves the right to cancel item collection/delivery should a previous customer return the item in a damaged condition, leaving the item unfit for the next customer.

 

 

FORCE MAJEURE

 

1.In the case of Force Majeure the Company is free of liability where there is cancellation which prevents the Company from executing their obligations due to any unforeseen and/or uncontrollable incident/event including but not limited to acts of man - theft, vandalism, acts of war, terrorism, government imposed restrictions and/or act of government, strike or industrial action or similar catastrophic event such as but not limited to civil or state emergency, fire, flood, earthquake, act of God, pandemic, disease outbreak or epidemic resulting in Force Majeure event which is beyond control of the Company. Where this occurs, and at the Company’s discretion, the Company will work with the Client to postpone their booking to a new date within 12 months of the original date or date of postponement (whatever is sooner), or where not practical the amount paid will be used as a credit note on a future bookings.

 

2.For any services or items which have been procured or sourced to fulfill the Client's booking, such as, but not limited to perishables (e.g.flowers and foliage), custom stationery, products or services from other businesses the Client acknowledges these costs will be required to be paid by the Client. The Company has the right to deny postponement until these costs are paid.

 

3. In the case that we cannot attend or fulfill your hire due to events beyond our control, we will contact you or the venue as soon as possible. In these instances our liability will be limited to refunding hire amounts paid by you as the customer. 

 

 

Additional Terms

 

Just Joy Events Ltd reserves the right to take photos at event locations utilising Just Joy Events Ltd equipment. Photos are taken with a focus on the equipment and are selected with due care to exclude recognisable private property and persons. Photos may be used in publications or other media produced, used, or contracted by Just Joy Events Ltd.

 

 

Limitation of Liability

 

1. Except where the company is in breach of a guarantee in terms of the Consumer Guarantees Act 1993, the client in entering into this contract acknowledges that in all other circumstances whatsoever Just Joy Events Ltd shall not be liable for direct, indirect, incidental or consequential damage, loss or expense whatsoever and howsoever arising (whether in contact or in tort) including that resulting from negligence of the Company or arising by operation of law and whether suffered by the Client and/or third party for any amount that exceeds the amount actually paid by the Client to Just Joy Events Ltd pursuant to this contract.

 

2. If the Client is acquiring the services for the purposes of a business as defined in the Consumer Guarantees Act 1993, the provisions of that Act do not apply.

 

3. If the Client is purchasing goods rather than hiring them, then except as prohibited by law, all guarantees in respect of the equipment, whether express or implied, are excluded.

 

4. If during the hire period, the Client moves, adjusts or removes any items/displays installed by Just Joy Events Ltd, Just Joy Events Ltd accepts no liability whatsoever for any loss, damage or injury sustained by the Client, or any other parties resulting from such activities.

 

5. The Hirer acknowledges that the Company has no liability to the Hirer for any indirect or consequential loss or damage or for any loss of profit (or any other form of economic loss) arising in connection with the agreement (whether in contract or in tort) including that resulting from the negligence of the Company or arising by operation of law.

 

6. The Hirer shall be liable to effect public risk insurance in relation to the Products for the duration of the period of hire. The public risk insurance shall cover any and all liability arising out of the Hirer's or any third party's use of the Equipment during the hire period, including but not limited to liability for property damage and personal injury.

 

7. The Hirer acknowledges that the use of the Equipment is at their own risk and agrees to indemnify and hold the Owner and its staff and agents harmless from and against any and all claims, damages, liabilities, losses, and expenses, including reasonable legal fees and costs, arising from or in connection with the use of the Equipment. The Hirer further agrees to release the Owner and its staff and agents from any liability for personal injury, property damage, or any other loss sustained by the Hirer or any third party as a result of the use of the Equipment. The Hirer agrees to indemnify the Owner and its staff and agents for any third-party claims, actions, demands, costs and expenses for damage or injury to person or property arising directly or indirectly out of the hire or use of the Equipment by the Hirer. The Hirer acknowledges that they have read and understood these terms and that they are legally binding.

 

SECTION 4 - PAYMENT

 

PAYMENT

 

1. All rental item prices are exclusive of 15% GST .

 

2. Customers are asked to make all payments to Just Joy Events Ltd via bank transfer. Bank details will be provided on the individual customer invoice. 

 

3. Payment of services and/or products from Just Joy Events Ltd. will be made in New Zealand Dollars (NZD)

 

4. A non-refundable 50% deposit of the overall service fee will be required to secure the event booking. 

 

5. Full payment will need to be made 7 days prior to the event.

 

6. Additional delivery charges may apply, and these will be provided on the individual customer invoice.

 

7. Should the customer be given a discount, this will be stated on the individual customer invoice.

 

8. Credit Card payments can be made at our premises or we can accept absent cards – you will need to provide us with your credit card number and expiry date – this information is not held. Payments using credit card will incur a surcharge of 3.5% to cover additional card fees charged by the bank.

 

9. If an invoice has not been paid in full by the due date (which is the date of collection or deliver) , interest on the total overdue amount shall accrue from that date, daily until the payment is received at a rate of 5% per calendar month and all interest shall compound monthly before and after any judgement until payment is received in full. Where a vendor client discount may apply, if payment has not been paid on time and as agreed, the discount is then forfeited, and where debt collection is necessary all recovery fees will be charged to the Client.

 

10. The Client is required to pay for any costs involved by the Company in exercising or attempting to exercise its rights as stipulated here in this agreement – which may include administration fees, legal fees and debt collection costs.

 

11. The bond will be refunded by Just Joy Events Ltd. to customers via Bank Deposit after the provided props and items are assessed for damages. The Bond is refunded within 5 business days

 

12. Bookings are only confirmed once payment has been received by Just Joy Events Ltd and a payment invoice has been provided.

 

13. All prices displayed of products or services advertised on our Website or via written agreement are subject to change without notice

 

14. In the event Just Joy Events Ltd is required to recover any unpaid cost, all legal costs involved with recovery will be paid by the Customer, on an indemnity basis; and where the account is referred to a collection agency, collection costs associated with the collection agency will be added to the balance outstanding and will be paid by the Client.

 

15. A minimum hire amount of $150 per event is required - not including delivery and pick up.

 

DEPOSIT

 

1. Customers are required to provide a deposit to secure their item[s], which is calculated at 50% per rented item, which is exclusive of GST.

 

2. The deposit due date is provided on the individual customer invoice.

 

3. On payment of the deposit, Just Joy Events Ltd will keep an item available for the customer for their specified event date

 

4. A 50% deposit is required within 24 hours of receiving your invoice. Failure to do so will result in all requested hire equipment being made available again for public hire. Full payment is to be paid no later than 7 days prior to the date of the Hirer's event. If the payment is not received by the due date, the Owner may cancel the booking without any further notice to the Hirer, and the Hirer will forfeit the deposit paid.

 

5. Payment must be made by bank transfer to the Owner's nominated bank account. The Hirer is responsible for any bank fees associated with the transfer.

BOND

 

1. For all items rented from our hire shop, the Hirer is required to pay a security/damage bond to the Owner, which will be held until the safe return of all items in the same condition as they were hired out and within the booking period allocated.

 

2. Bond calculation as percentage of the total rent (before any discounts). Customers are asked to provide a minimum bond of $150.00 NZD.

 

3. The bond price may vary depending on the item or quantity of items the customer wishes to hire. The bond price will be outlined on each individual invoice.

 

4. The bond will be returned within 5 working days given the item[s] has/have been returned and inspected to ensure that it/they has/have not been soiled or damaged.

 

5. The bond will be refunded to the Hirer once all items have been returned and inspected by the Owner. If any items are found to be damaged or missing, the cost of repair or replacement will be deducted from the bond. If the cost of repair or replacement exceeds the amount of the bond, the Hirer will be responsible for covering the remaining amount.

 

SECTION 5- CANCELLATION AND VARIATIONS

 

 

1. Just Joy Events Ltd cannot cancel any order that has already been made up, even if the order is not yet delivered. unless cancellations made 90 days or more in advance of the event date due to the specific flowers have been ordered in specially to fulfill the order and organised most of your items and in circumstances where we have had to purchase special order items (such as plinths, backdrops etc) we are unable to provide any refund on these items. We are happy to rebook it to a diffetent dates, restocking fee might apply. We reserve the right to charge for these specific blooms and purchased items even if order is cancelled before make up.

 

2. Custom hire order cancellation/changes may incur a cost and will be subject to hire item/s

 

3.  Cancellation made by the Hirer must be in writing as soon as possible(Email: info@justjoyevents.co.nz) and received by the Owner at least 30 days prior to the hire date.    Cancellations made after the deposit has been made will be subject to the following:

 

  • Cancellations made 90 days or more in advance of the event date, will receive a 100% refund minus administration fee $50.    Any items already purchased by Just Joy Events Ltd for your hire/event will be charged to the client.

  • Cancellation made four weeks or more prior to the hire date will result in a loss of 50% of the total booking cost.

  • If the customer cancels four to one week from their collection/delivery date, they will be refunded 25% of their deposit.

  • Cancellation made less than 7 days prior to the hire date will result in a loss of 100% of the total booking cost.

 

4. The Owner may, at their discretion, offer the Hirer the opportunity to reschedule the hire to an alternative date subject to availability.    If the Hirer chooses to reschedule, any deposit or payment made will be carried forward to the new booking date.

 

5. If, for any reason, the Owner is unable to provide the goods specified in the booking form, the Owner will notify the Hirer as soon as possible and provide alternative options.  These options may include providing substitute goods of equal or higher value, adjusting the rental fee to reflect the changes, or cancelling the order.

 

6. Just Joy Events Ltd must be informed 3 days prior to the collection/delivery date if the customer wishes to change their collection/delivery date.

 

7. Customers may change the date of their event up to three times.

 

SECTION 6 - REFUNDS POLICY

 

1. Just Joy Events will asses each refund request on a case by case basis. Any complaints must be made within 24 hours. We are able to offer other solutions such as resending the product or resending a different product to the same value. The remedy will be determined at our complete discretion.

 

2. For hire services, there is no refund if cancelled within one week before the event date, 25% refund if cancelled before 2 weeks, 50% refund if cancelled between 2 weeks and 4 weeks, 100% refund if cancelled before 90 days, subject to a cancellation fee of $50.

 

3.No refunds are available for cancellation of goods once balloons have been inflated or inflated balloons have been dispatched.  A change of mind once the balloons have been inflated has no refunds policy as we are unable to reuse any of the materials.

 

4. In the unlikely event that you feel we have not provided the gift that you have ordered, we will investigate the circumstances and if required, a partial refund or credit may be duly issued.

 

5.No refunds will be provided for items that are hired and not utilised.

 

6. Once balloons have been delivered, we will deem that the balloons are accepted as-is condition and no refunds will be issued It is your responsibility for the balloons once they are collected.  If we are delivering the balloons and there is a problem, we will make sure it is replaced.

 

7. We DO NOT REFUND if you got what you asked for but simply changed your mind, found it cheaper somewhere else, decided you did not like the purchase or had no use for it.

 

8. We will not provide a refund or replace a product that has been misused, mishandled or incorrectly installed or serviced after a successful delivery.

 

9. You are not entitled to a refund if we are unable to deliver your order due to being supplied with an incorrect address or being unable to access a secure property.

SECTION 7 - COLOUR AND IMAGE DISCLAIMER

1.Though we try to provide an accurate image of the props. the product’s colours may vary slightly, due to different device screen settings, the lighting and other factors. However, the Customer is responsible for ensuring they have chosen their desired product.

 

2. Our illustrations are for illustrative purposes only. The actual product may differ from the illustrative images shown however should most resemble that of the illustrative image.

SECTION 8 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION 

We are not responsible if information made available on this site is not accurate, complete or current.
